It also has two (2) regional offices in Cameroon and Rwanda.<\/p>\n<p>Detailed information on the environment, organization and activities of the Fund is available on its website: <a href=\"http:\/\/www.fagace.org\/\">www.fagace.org<\/a>.<\/p>\n<ol start=\"2\">\n<li><strong>MISSION BACKGROUND AND RATIONALE<\/strong><\/li>\n<\/ol>\n<p>In line with its 2021-2025 strategic plan, whose vision is &#8220;to make FAGACE a modern institution that contributes fully to the economic and social development of its member states&#8221;, FAGACE has planned to strengthen its human capital in order to achieve its objectives more quickly and efficiently, guaranteeing greater productivity.<\/p>\n<p>The purpose of these Terms of Reference (&#8220;ToR&#8221;) is to define the terms and conditions for the recruitment of a firm specializing in the recruitment and provision of senior international civil servants.<\/p>\n<ol start=\"3\">\n<li><strong>CONSULTATION OBJECTIVE<\/strong><\/li>\n<\/ol>\n<p>FAGACE hereby invites eligible firms to express their interest in assisting it in the process of strengthening its human capital.<\/p>\n<p>In line with the orientations set out in the Strategic Plan, the long-term objective is to have highly qualified human resources available for the various positions to be filled at FAGACE.<\/p>\n<ol start=\"4\">\n<li><strong>MISSION BENEFICIARIES<\/strong><\/li>\n<\/ol>\n<p>Beneficiaries are all FAGACE stakeholders.<\/p>\n<ol start=\"5\">\n<li><strong>MISSION CONTENT<\/strong><\/li>\n<\/ol>\n<p>As part of this mission to support the strengthening of FAGACE&#8217;s human capital, the firm will be responsible for the following main tasks:<\/p>\n<ul>\n<li>Search for potential candidates in accordance with the specifications;<\/li>\n<li>Review applications and submit a long list of the top ten (10) candidates, based on suitability for the position;<\/li>\n<li>Select, test, interview, evaluate and check references of potential candidates;<\/li>\n<li>Present a short list of five (05) candidates to FAGACE, with a decreasing ranking according to the level of suitability for the position;<\/li>\n<li>Draw up an assignment report detailing all the stages (advertising, screening, tests used, interviews, reference checks, etc.) and the internal resources involved in the process. The final report must clearly specify the list of three (03) candidates recommended by the firm for the position; it must also contain a list of all candidates who applied, as well as their profile (degree, experience, country).<\/li>\n<li>Carry out any other task deemed necessary to achieve the objectives as agreed between the parties.<\/li>\n<\/ul>\n<ol start=\"6\">\n<li><strong>EXPECTED RESULTS<\/strong><\/li>\n<\/ol>\n<ul>\n<li>Proposal of 03 relevant candidates for each position to be filled;<\/li>\n<li>Cultural diversity (FAGACE member countries) respected in the candidates proposed for each position.<\/li>\n<\/ul>\n<ol start=\"7\">\n<li><strong>DELIVERABLES<\/strong><\/li>\n<\/ol>\n<ul>\n<li>The report on the collection, evaluation and pre-selection of applications and related files;<\/li>\n<li>Short list selection and presentation report;<\/li>\n<li>The report on the morality investigations of the short-list candidates;<\/li>\n<li>Final mission report.<\/li>\n<\/ul>\n<p>Deliverables, written in French, must be provided in a form satisfactory to FAGACE. Once validated, all reports will be submitted to FAGACE in hard copy, in three (3) copies, with a parallel submission by e-mail (in Word and PDF format).<\/p>\n<p>The final mission report must be sent to FAGACE within fifteen (15) days of the end of the mission.<\/p>\n<ol start=\"8\">\n<li><strong>QUALIFICATION AND PROFILE OF THE FIRM<\/strong><\/li>\n<\/ol>\n<p>To take part in this consultation, the firm must demonstrate that it has all the skills and guarantees required to carry out this assignment under the right conditions. To this end, the tender file must include the following documents:<\/p>\n<ul>\n<li>A letter of expression of interest ;<\/li>\n<li>A detailed presentation of the bidder (CV of the head of the firm) clearly indicating its skills and the human and material resources it has available to carry out the work (profile of experts involved in the process, etc.);<\/li>\n<li>The proposed methodology ;<\/li>\n<li>Recent and significant technical references (proof of successful completion at local and international levels during 2022-2023) concerning the satisfactory execution of similar contracts;<\/li>\n<li>A certificate of non-bankruptcy dated less than three (03) months before the bid submission date, issued by the Court;<\/li>\n<li>An original certificate from the Social Security proving that the bidder is up to date with the said Fund up to the last quarter due on the date of submission of bids;<\/li>\n<li>An original tax certificate proving that the bidder is up to date with tax payments up to the last due date;<\/li>\n<li>A copy of the Unique Identifier (IFU) specifically for bidders based in BENIN ;<\/li>\n<li>A description of the proposed methodology for carrying out the assignment, and the proposed schedule for carrying out the assignment.<\/li>\n<\/ul>\n<p>NB: the absence of any of the documents listed above will result in the systematic rejection of the tender file.<\/p>\n<p><strong>9. PRESENTATION OF SERVICE PROPOSALS<\/strong><\/p>\n<p>Interested firms should send four (4) copies of their tender documents to the Fund, including one (1) original and three (3) copies, all in a single sealed envelope marked: &#8220;<strong>Mission d&#8217;accompagnement au recrutement de hauts cadres pour le FAGACE<\/strong>&#8220;.<\/p>\n<p>Bids must reach the Fund&#8217;s headquarters in Cotonou, in a closed envelope, no later than October 26, 2023 at 5:00 p.m. (local time), at the following address<\/p>\n<p><strong>African Guarantee and Economic Cooperation Fund<\/strong><\/p>\n<p><strong>298, Boulevard CEN-SAD<\/strong><\/p>\n<p><strong>Rue 12 044 Cotonou<\/strong><\/p>\n<p><strong>01 BP 2045 Cotonou (Benin)<\/strong><\/p>\n<p><strong>For the attention of<\/strong><\/p>\n<p><strong>Monsieur le Directeur G\u00e9n\u00e9ral du Fonds Africain de Garantie et de Coop\u00e9ration Economique<\/strong><\/p>\n<p>Tender dossiers that obtain a score lower than the minimum technical score of seventy (70) points will be rejected. Tender dossiers must not include any financial information.<\/p>\n<p>FAGACE reserves the right to verify the information provided by the bidder.<\/p>\n<p><strong>10. MODIFICATION OF THE EXPRESSION OF INTEREST<\/strong><\/p>\n<p>FAGACE may, for any reason whatsoever, on its own initiative or following a request for clarification submitted by a bidder, modify the expression of interest by publishing, as the case may be, an Addendum or a Corrigendum on the official FAGACE website., <a href=\"http:\/\/www.fagace.org\/\">www.fagace.org<\/a>.<\/p>\n<p>The Addendum or Corrigendum will be notified five (05) days before the deadline for receipt of bids.<\/p>\n<p><strong>11. Submissions ranked in the &#8220;Poor&#8221; category will be excluded from the rest of the process.<\/p>\n<p>At the end of the selection process, the FAGACE Contracts Committee will draw up a report ranking the consultants, and a shortlist will be drawn up for the rest of the process.<\/p>\n<p>Before the contract is finally awarded, it will be negotiated with the selected consultant. Negotiations will focus on :<\/p>\n<ul>\n<li>the technical conditions for implementing the assignment, including a detailed schedule,<\/li>\n<li>methodological approach,<\/li>\n<li>the content of deliverables,<\/li>\n<li>the financial proposal.<\/li>\n<\/ul>\n<p><strong>\u00a012.PAYMENT TERMS<\/strong><\/p>\n<p>Payment terms will be defined as follows:<\/p>\n<p>Fees will be invoiced in instalments according to progress and subject to validation of deliverables by FAGACE.<\/p>\n<p>Payment terms will be defined once the service provider has been selected, and will be specified in the service contract to be signed by the parties. However, payment will be made according to the deliverables expected and validated:<\/p>\n<ul>\n<li>The report on the collection, evaluation and pre-selection of applications and related files;<\/li>\n<li>Short list selection and presentation report;<\/li>\n<li>The report on the morality investigations of the short-list candidates;<\/li>\n<li>Le rapport final de mission.<\/li>\n<\/ul>\n<p><strong>13. LATE PENALTIES<\/strong><\/p>\n<p>For any delay in the execution of the assignment in relation to the schedule established by mutual agreement, a penalty of 0.1% of the total amount per day of delay will be applied to the consultants without prior formal notice.<\/p>\n<p>However, the total amount of the penalty must not exceed five percent (5%) of the final contract amount.<\/p>\n<p><strong>14. COSTS OF PRESENTING THE SERVICE OFFERING<\/strong><\/p>\n<p>The cost of submitting the service offer, as well as any other costs incurred in negotiating the contract, are not reimbursable.<\/p>\n<p>Whatever the outcome of the consultation, no compensation can be claimed by individual bidders.<\/p>\n<p><strong>15. PRIVACY<\/strong><\/p>\n<p>All documents drawn up in connection with this assignment will be the property of FAGACE and will remain confidential.<\/p>\n<p>The consultant retained for the present mission is bound to respect strict confidentiality with regard to third parties, for all information to which he will have access before, during and after the mission or collected on its occasion. Any breach of this clause will result in immediate termination of the assignment.<\/p>\n<p>This confidentiality remains in force without limitation after the end of the assignment.<\/p>\n<p><strong>16. DEADLINE FOR THE VALIDITY OF BIDS<\/strong><\/p>\n<p>Bids will be valid for a period of ninety (90) days from the day following the deadline for receipt of bids.<\/p>\n<p>A bid valid for a shorter period will be rejected by FAGACE as not complying with the provisions of the consultation documents.<\/p>\n<p><strong>17. COMPLIANCE WITH CONSULTATION CONDITIONS<\/strong><\/p>\n<p>The submission of a bid does not entitle the bidder to any restitution or reservation of the clauses and conditions set out in these specifications.<\/p>\n<p>In addition, and by the mere fact of submitting their bids, tenderers are deemed to have collected, on their own initiative and under their sole responsibility, any information they deem necessary for the full performance of their obligations under the constituent documents.<\/p>\n<p><strong>18. CONTRACT REGISTRATION FEE<\/strong><\/p>\n<p>Registration fees are payable by the bidder in accordance with current legislation.<\/p>\n<p><strong>19. TERMINATION OF CONTRACT<\/strong><\/p>\n<p>FAGACE may terminate the contract by operation of law after prior notice:<\/p>\n<ul>\n<li>in the event of non-performance by the consultant of any of the clauses of the contract,<\/li>\n<li>when the consultant engages in fraudulent acts during the performance of the contract, in particular concerning the nature or quality of the services,<\/li>\n<li>in the event of bankruptcy or insolvency,<\/li>\n<li>in the event that the contract holder makes, either personally or through an intermediary, promises, gifts or presents with a view to influencing the various procedures for concluding a contract and the stages of its completion.<\/li>\n<\/ul>\n<p><strong>20. SETTLEMENT OF DISPUTES<\/strong><\/p>\n<p>Any dispute relating to the signed service contract which the parties are unable to settle amicably shall be submitted to arbitration\/conciliation in accordance with Beninese law.<\/p>\n<p>Failing this, the dispute will be submitted to the competent Beninese courts and the matter will be handled in accordance with Beninese law.<\/p>\n<p><strong>21. CONFLICTS OF INTEREST<\/strong><\/p>\n<p>Cases of conflict of interest, i.e. those who have any direct or indirect interest in the project or who have a personal or professional relationship with FAGACE, must declare their conflict of interest when submitting their letter of application for the assignment; in particular, any civil servant exercising an administrative function must present the necessary authorizations to carry out the assignment.<\/p>\n<p><strong>22.
